1. Introduction and Aggregator Model

Welcome to TreepGo. These Terms and Conditions govern your use of our website and mobile application. TreepGo operates as a technology platform (aggregator) that connects registered users (Riders) with independent third-party transportation providers (Captains) who offer bike, auto, and cab services. TreepGo itself does not provide transportation services.

2. User Accounts

2.1 Eligibility: You must be at least 18 years old to create an account and use our services. By creating an account, you represent and warrant that you meet this age requirement.

2.2 Account Security: You are responsible for maintaining the confidentiality of your account login information. You agree to notify us immediately of any unauthorized use of your account.

2.3 Accuracy of Information: You agree to provide current, accurate, and complete information during the registration process and to update such information to keep it accurate and current.

3. Booking and Services

3.1 Service Description: TreepGo provides a platform to book two-wheelers (Bikes), three-wheelers (Autos), and four-wheelers (Cabs). Availability is subject to the active status of Captains in your area.

3.2 Ride Requests: When you request a ride, you will be provided with an estimated fare. The final fare may vary due to route changes, traffic, or wait times.

3.3 Right to Refuse Service: Captains reserve the right to refuse service if they feel unsafe, if the passenger exceeds vehicle capacity (e.g., more than 1 pillion rider on a bike), or if luggage guidelines are violated.

4. Payments and Fares

4.1 Fare Calculation: Fares are calculated based on base rates, time, distance, and potential surge pricing during periods of high demand. The estimated fare provided at the time of booking may differ from the final fare.

4.2 Payment Methods: We accept payments via credit cards, debit cards, UPI, and authorized digital wallets. Cash payments may be accepted depending on local regulations and service availability.

4.3 Authorization: By adding a payment method to your account, you authorize us to charge your payment method for all rides and associated fees (such as cancellation fees or damage fees) incurred through your account.

5. Cancellation and Refund Policy

5.1 Rider Cancellation: You may cancel a ride request. However, if you cancel after a Captain has been dispatched or arrived, a cancellation fee may apply to compensate the Captain for their fuel and time.

5.2 Captain Cancellation: If a Captain cancels a requested ride, you will not be charged. Our system will attempt to automatically assign a new Captain.

5.3 Refunds: If you believe you were charged incorrectly, please contact our support team within 7 days of the ride. Refunds are issued at our sole discretion based on a review of the trip details.

6. User Conduct & Safety

6.1 Acceptable Behavior: You agree to treat our Captains and their vehicles with respect. You must wear a helmet during bike rides (provided by the Captain or your own) and abide by local traffic laws.

6.2 Vehicle Damage: You are responsible for any damage caused to the Captain's vehicle beyond normal wear and tear.

7. Limitation of Liability

To the maximum extent permitted by law, TreepGo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties.

8. Privacy Policy

Your use of our services is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information, including location data. By using TreepGo, you consent to our data practices as described in the Privacy Policy.

9. Modifications to the Terms

We reserve the right to modify these Terms and Conditions at any time. We will provide notice of any material changes by posting the updated terms on our platform. Your continued use of the services after such modifications constitutes your acceptance of the new terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the services shall be subject to the exclusive jurisdiction of the courts located in India.
